{"id":85,"date":"2019-09-18T00:19:06","date_gmt":"2019-09-18T00:19:06","guid":{"rendered":"http:\/\/humanepestpro.com\/?page_id=85"},"modified":"2022-12-09T19:38:45","modified_gmt":"2022-12-09T19:38:45","slug":"laws-regulations","status":"publish","type":"page","link":"https:\/\/humanepestpro.com\/?page_id=85","title":{"rendered":"Laws &#038; Regulations"},"content":{"rendered":"\n\t<p>Below, are\u00a0some of California&#8217;s laws and regulations, and local ordinances that pertain\u00a0to\u00a0wildlife, with our\u00a0interpretation italicized. We&#8217;ve\u00a0also included some examples from other states and countries.<\/p>\n<p>&nbsp;<\/p>\n<p>CALIFORNIA CODE OF REGULATIONS, TITLE 14<\/p>\n<p><strong>\u00a7465.5 (f)(1).\u00a0Trap Number Requirement<\/strong>. Any person who traps furbearing mammals or nongame mammals shall obtain a trap\u00a0number issued by and registered with the department. All traps, before being put into use, shall bear only the current registered\u00a0trap number or numbers of the person using, or in possession of those traps. This number shall be stamped clearly on the trap\u00a0or on a metal tag attached to the chain of the trap or to any part of the trap.<\/p>\n<blockquote>\n<p><em>It is illegal to set or maintain traps that do not bear a number or other identifying mark registered with the Department of Fish and\u00a0Wildlife. This would include a property owner who wishes to set a trap for a wild animal in his\/her backyard &#8211; before doing so,\u00a0they must receive an identifying number and affix it to the trap.<\/em><\/p>\n<\/blockquote>\n<p><strong>\u00a7465.5 (g)(1).\u00a0Immediate Dispatch or Release.<\/strong> All furbearing and nongame mammals that are legal to trap must be immediately\u00a0killed or released. Unless released, trapped animals shall be killed by shooting where local ordinances,\u00a0landowners, and safety permit. This regulation does not prohibit employees of\u00a0federal, state, or local government from using chemical euthanasia to dispatch\u00a0trapped animals.\u00a0Trapped animals must be euthanized or released immediately on site. Relocation of trapped wildlife is prohibited.<\/p>\n<p><strong>\u00a7465.5 (g)(2).\u00a0Trap Visitation Requirement.<\/strong> All traps shall be visited at least once daily by the owner of the traps or his\/her\u00a0designee. Each time traps are checked all trapped animals shall be removed.\u00a0<\/p>\n<p><strong>\u00a7465.5 (g)(3).\u00a0Trap Placement Requirement.<\/strong> Traps may not be set within 150 yards of any structure used as a permanent or\u00a0temporary residence, unless such traps are set by a person controlling such property or by a person who has and is carrying\u00a0with him written consent of the landowner to so place the trap or traps.<\/p>\n<blockquote>\n<p><em>Simply put, no person may set a trap within 150 yards of a residence without written consent from the owner of that residence.\u00a0We believe this regulation was initially written to help protect domestic animals from being trapped and injured. Today, we\u00a0believe this subsection\u00a0provides\u00a0neighbors an important right &#8211; a say in what happens to\u00a0shared natural resources &#8211; the wildlife.<\/em><\/p>\n<\/blockquote>\n<p><strong>\u00a7475 (a).\u00a0Poison may not be used.<\/strong><\/p>\n<p>To check on a license or report a possible trapping violation, contact the Department of Fish and Wildlife Trapping License Office\u00a0916-928-5852 or one of the regional offices:<\/p>\n<p>FRESNO &#8211; 1234 E. Harassment of Animals.\u00a0<\/strong>Except as otherwise authorized in these regulations or in the Fish and Game Code, no person shall harass, herd or drive any\u00a0game or nongame bird or mammal or furbearing mammal. For the purposes of this section, harass is defined as an intentional act\u00a0which disrupts an animal&#8217;s normal behavior patterns, which includes, but is not limited to, breeding, feeding or sheltering. This\u00a0section does not apply to a landowner or tenant who drives or herds birds or mammals for the purpose of preventing damage to\u00a0private or public property, including aquaculture and agriculture crops.<\/p>\n<p><strong>\u00a7251.3. Prohibition Against Feeding Big Game Mammals.<\/strong>\u00a0No person shall knowingly feed big game mammals, as defined in Section 350 of these regulations<\/p>\n<p>&nbsp;<\/p>\n<p>CALIFORNIA FISH AND GAME CODE<\/p>\n<p>4152: Non-Game birds and mammals injuring crops and property (includes red fox squirrel and jack rabbits) may be taken any\u00a0time and in any manner in accordance with the regulations&#8230;<\/p>\n<p>4180:\u00a0Furbearing mammals damaging property may be taken in any manner in accordance with this code and regulations&#8230;<\/p>\n<blockquote>\n<p><em>Wildlife injuring crops of property can be &#8220;taken&#8221; or killed, but only in accordance with current regulations (below).<\/em><\/p>\n<p><em>Additionally, there must be cause &#8211; damage to crops or property before fur-bearers or non-game mammals may be taken, and\u00a0then, only the animal(s) causing the damage may be taken &#8211; non-target animals that are inadvertently trapped must be\u00a0immediately released on site.<\/em><\/p>\n<\/blockquote>\n<p><strong>\u00a74004. Unlawful Methods of Taking<\/strong>.\u00a0It is unlawful to do any of the following:<\/p>\n<p>(a) Use a steel-jawed leghold trap, or use any trap with saw-toothed or spiked jaws.<\/p>\n<p>(b) Use a body-gripping trap, as defined in subdivision (a) of Section 3003.1, for the purpose of recreation or commerce in fur.<\/p>\n<p>(c) Set or maintain traps that do not bear a number or other identifying mark registered to the department or, in the case of a\u00a0federal, state, county, or city agency, bear the name of that agency, except that traps set pursuant to Section 4152 or 4180 shall\u00a0bear an identifying mark in a manner specified by the department. No registration fee shall be charged pursuant to this\u00a0subdivision.<\/p>\n<p>(d) Fail to visit and remove all animals from traps at least once daily. If the trapping is done pursuant to Section 4152 or 4180,\u00a0the inspection and removal shall be done by the person who sets the trap or the owner of the land where the trap is set or an\u00a0agent of either.<\/p>\n<p>(e) Use a conibear trap that is larger than 6 inches by 6 inches, unless partially or wholly submerged in water. Unless prohibited\u00a0by the department as a permit condition, a lawfully set conibear trap that is 10 inches by 10 inches or less may be set pursuant\u00a0to subdivision (g) of Section 465.5 of Title 14 of the California Code of Regulations.<\/p>\n<p>(f) When any conibear trap is set on publicly owned land or land expressly open to public use, fail to post New 4 signs at every\u00a0entrance and exit to the property indicating the presence of conibear traps and at least four additional signs posted within a\u00a0radius of 50 feet of the trap, one in each cardinal direction, with lettering that is a minimum of three inches high stating: \u201cDanger!\u00a0Traps Set For Wildlife. Keep Out.\u201d Signs shall be maintained and checked daily.<\/p>\n<p>(g) Kill any trapped mammal in accordance with this section by intentional drowning, injection with any chemical not sold for the\u00a0purpose of euthanizing animals, or thoracic compression, commonly known as chest crushing. This subdivision shall not be\u00a0construed to prohibit the use of lawfully set conibear traps set partially or wholly submerged in water for beaver or muskrat or the\u00a0use of lawfully set colony traps set in water for muskrat.<\/p>\n<p>&nbsp;<\/p>\n<p>CALIFORNIA PENAL CODE<\/p>\n<p><strong>\u00a7597.\u00a0Cruelty to Animals.<\/strong> (a) Except as provided in subdivision (c) of this section or Section 599c, every person who maliciously\u00a0and intentionally maims, mutilates, tortures, or wounds a living animal, or maliciously and intentionally kills an animal, is guilty of\u00a0an offense punishable by imprisonment in the state prison, or by a fine of not more than twenty thousand dollars ($20,000), or by\u00a0both the fine and imprisonment, or, alternatively, by imprisonment in a county jail for not more than one year, or by a fine of not\u00a0more than twenty thousand dollars ($20,000), or by both the fine and imprisonment. (b) Except as otherwise provided in\u00a0subdivision (a) or (c), every person who overdrives, overloads, drives when overloaded, overworks, tortures, torments, deprives\u00a0of necessary sustenance, drink, or shelter, cruelly beats, mutilates, or cruelly kills any animal, or causes or procures any animal\u00a0to be so overdriven, overloaded, driven when overloaded, overworked, tortured, tormented, deprived of necessary sustenance,\u00a0drink, shelter, or to be cruelly beaten, mutilated, or cruelly killed; and whoever, having the charge or custody of any animal, either\u00a0as owner or otherwise, subjects any animal to needless suffering, or inflicts unnecessary cruelty upon the animal, or in any\u00a0manner abuses any animal, or fails to provide the animal with proper food, drink, or shelter or protection from the weather, or\u00a0who drives, rides, or otherwise uses the animal when unfit for labor, is, for every such offense, guilty of a crime punishable as a\u00a0misdemeanor or as a felony or alternatively punishable as a misdemeanor or a felony and by a fine of not more than twenty\u00a0thousand dollars ($20,000). (c) Every person who maliciously and intentionally maims, mutilates, or tortures any mammal, bird,\u00a0reptile, amphibian, or fish as described in subdivision (d), is guilty of an offense punishable by imprisonment in the state prison,\u00a0or by a fine of not more than twenty thousand dollars ($20,000), or by both the fine and imprisonment, or, alternatively, by\u00a0imprisonment in the county jail for not more than one year, by a fine of not more than twenty thousand dollars ($20,000), or by\u00a0both the fine and imprisonment. (d) Subdivision (c) applies to any mammal, bird, reptile, amphibian, or fish which is a creature\u00a0described as follows: (1) Endangered species or threatened species as described in Chapter 1.5 (commencing with Section\u00a02050) of Division 3 of the Fish and Game Code. (2) Fully protected birds described in Section 3511 of the Fish and Game Code.\u00a0(3) Fully protected mammals described in Chapter 8 (commencing with Section 4700) of Part 3 of Division 4 of the Fish and\u00a0Game Code. (4) Fully protected reptiles and amphibians described in Chapter 2 (commencing with Section 5050) of Division 5 of\u00a0the Fish and Game Code. (5) Fully protected fish as described in Section 5515 of the Fish and Game Code. This subdivision\u00a0does not supersede or affect any provisions of law relating to taking of the described species, including, but not limited to,\u00a0Section 12008 of the Fish and Game Code. (e) For the purposes of subdivision (c), each act of malicious and intentional\u00a0maiming, mutilating, or torturing a separate specimen of a creature described in subdivision (d) is a separate offense. If any\u00a0person is charged with a violation of subdivision (c), the proceedings shall be subject to Section 12157 of the Fish and Game\u00a0Code.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>SAN BERNARDINO COUNTY<\/p>\n<p>TITLE 3: HEALTH AND SANITATION AND ANIMAL REGULATIONS<\/p>\n<p>DIVISION 2: ANIMALS<\/p>\n<p>CHAPTER 13: ANIMAL FOOD AND FOOD SCRAPS<\/p>\n<p><strong>\u00a7 32.1301 Food Left Outside for Certain Mammalian Predators.<\/strong>\u00a0(a) No person shall feed or in any manner provide food for one or more non-domesticated\u00a0mammalian predators. A non-domesticated mammalian predator shall include coyotes, raccoons,\u00a0foxes, opossums, bears, mountain lions, and bobcats.<\/p>\n<p><strong>\u00a7 32.1302 Food Left Outside for Any\u00a0Animal During Certain Hours.<\/strong>\u00a0No person shall leave or permit to be left out-of-doors food for any animal between the hours of\u00a010:00 p.m. of any one day and 6:00 a.m. of the following day, unless the area where the food is\u00a0left is not accessible to non-domesticated mammalian predators.<\/p>\n<p><strong>\u00a7 32.1303 Garbage Containing Food Scraps.\u00a0<\/strong>No person shall leave or permit to be left out-of-doors any garbage containing food scraps without\u00a0first securing said food scraps in closed containers.<\/p>\n<p>&nbsp;<\/p>\nCITY OF SAN JOSE<br \/>\n\n<p>BAN ON FEEDING WILDLIFE\u00a0<\/p>\n<p>7.40.120 &#8211; Ban on feeding wild animals.<\/p>\n<p>A. It is unlawful for any person to feed or in any manner provide an attractant to a wild animal.<\/p>\n<p>B. No person may leave, store, or maintain any attractant in a location and manner accessible to any wild animal.<\/p>\n<p>C. The prohibitions in subsections A. and B. do not apply to: 1. Any person who is the legal owner\/guardian of the wild animal and the wild animal is kept under a valid license or permit\u00a0issued by the State Department of Fish and Game, and in compliance with all applicable laws. 2. Any person who feeds or provides an attractant to a trapped, injured, or unweaned wild animal between the time that the\u00a0agency charged with animal control or its designated agent is notified of the wild animal and the wild animal is picked up by\u00a0said agency. 3. A wildlife rehabilitator. 4. Any person who is using an attractant to trap an animal in a legally authorized or permitted manner. 5. Any person with a bird feeder provided the feeders are suspended on a cable or other device to make them inaccessible to\u00a0wild animals and the area below the feeders are kept free from the accumulation of seed debris.<\/p>\n<p>&nbsp;<\/p>\nLOS ANGELES COUNTY<br \/>\n\n<p>FEEDING OF CERTAIN PREDATOR ANIMALS\u00a0<\/p>\n<p>10.84.010 &#8211; Providing food for certain rodents or predator animals prohibited.\u00a0<\/p>\n<p>A. Except as otherwise provided for herein, no person shall feed or in any manner provide food\u00a0to a nondomesticated rodent or a nondomesticated mammalian predator.<\/p>\n<p>B. For purposes of this chapter:<\/p>\n<p>1. &#8220;Rodent&#8221; includes ground squirrels;<\/p>\n<p>2. &#8220;Mammalian predators&#8221; includes coyote, raccoon, fox and opossum.<\/p>\n<p>&nbsp;<\/p>\n<p>LOS ANGELES CITY MUNICIPAL CODE<\/p>\n<p>CHAPTER 5, ARTICLE 3\u00a0ANIMALS AND FOWLS<\/p>\n<p><strong>SEC. 53.06.3. Traping &#8211; Permit Required.<\/strong>\u00a0<\/p>\n<p>(a) No person shall set, or cause to be\u00a0set, any trap to catch any animal, other than rats, mice,\u00a0pocket gophers, ground squirrels and\u00a0moles, without having first obtained a permit therefor from the\u00a0Department prior to the setting of\u00a0any such trap.\u00a0<\/p>\n<p>(b) The Department shall charge and collect for issuance of a permit to trap a\u00a0coyote a fee of\u00a0$200.00.\u00a0<\/p>\n<p>(c) The Department shall establish conditions which the applicant for a\u00a0permit to trap a coyote\u00a0must satisfy prior to the issuance of any such permit. If the General\u00a0Manager or the General\u00a0Manager\u2019s designee determines that the applicant has satisfied the\u00a0conditions, then the Department\u00a0shall issue a permit to trap a coyote. The Department shall\u00a0further ensure that those conditions will\u00a0be maintained and that the permittee shall inform\u00a0neighboring residents, located within a distance\u00a0established by the Department, that coyote\u00a0trapping will be occurring in their area.\u00a0<\/p>\n<p>(d) No person shall set, or cause to be set, any snare,\u00a0body gripping trap, body crushing trap,\u00a0deadfall trap, leg hold trap, or any trap or snare that\u00a0captures an animal other than rats, mice, pocket\u00a0gophers, ground squirrels and moles, by\u00a0gripping or snaring any part of the animal including its\u00a0body, head, neck or limb, or that maims or\u00a0causes the inhumane death or suffering of any animal.\u00a0<\/p>\n<p>(e) The Department shall promulgate rules and regulations which are reasonably necessary to\u00a0minimize the suffering of animals trapped in humane traps such as box, culvert or cage traps.\u00a0These\u00a0rules and regulations may include the placement of the traps and visitation schedules,\u00a0identification\u00a0and contact information for the trap, the type and use of permissible bait, and the\u00a0treatment of the\u00a0trapped animals.\u00a0<\/p>\n<p>CODE OF FEDERAL REGULATIONS<\/p>\n<p>TITLE 50: WILDLIFE and FISHERIES<\/p>\n<p>PART 21: MIGRATORY BIRD PERMITS<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Excerpts from 50 CFR 21.43 \u00ad Depredation order for blackbirds, cowbirds,\u00a0crows, grackles,\u00a0and magpies.<\/strong><\/p>\n<p>(b) Conditions under which control is allowed by private citizens.\u00a0You\u00a0do not need\u00a0a Federal permit to\u00a0control the species listed in\u00a0paragraph (a)\u00a0of this section in the\u00a0following circumstances: (1)\u00a0Where they are causing serious injuries to agricultural or horticultural crops or to\u00a0livestock feed;<\/p>\n<p>(6)\u00a0Each calendar year,\u00a0you\u00a0must attempt to control depredation by species listed under\u00a0this depredation order\u00a0using nonlethal methods before\u00a0you\u00a0may use lethal control.\u00a0Nonlethal control methods can include such measures\u00a0as netting and flagging, the use of\u00a0trained raptors, propane cannons, and recordings.<\/p>\n<p>(f) Trapping conditions.\u00a0You\u00a0must comply with the following conditions if\u00a0you\u00a0attempt\u00a0to trap any species under\u00a0this order. (2)\u00a0You\u00a0must check each trap at least once every day it is deployed. (3)\u00a0At temperatures above 80 \u00b0Fahrenheit, the traps must provide shade for captured birds. (4)\u00a0Each trap must contain adequate food and water.\u00a0(7)\u00a0You\u00a0must report captures of nontarget federally protected migratory birds in\u00a0your\u00a0annual report. (g) Euthanasia.\u00a0Captured birds and wounded or injured birds of the species listed in\u00a0paragraph (a) may only be\u00a0killed by\u00a0carbon monoxide or carbon dioxide\u00a0inhalation, or by cervical dislocation performed by well\u00ad trained personnel\u00a0who are regularly monitored to ensure proficiency. (i) Annual report.\u00a0Any person, business, organization, or government official acting\u00a0under this depredation order\u00a0must provide an annual report using FWS Form\u00a03\u00ad202\u00ad21\u00ad2143 to the appropriate Regional Migratory Bird Permit\u00a0Office. (j) Compliance with other laws.\u00a0You\u00a0may trap and kill birds under this order only in\u00a0a way that complies with all\u00a0State, tribal, or territorial laws or regulations.\u00a0You\u00a0must\u00a0have any State, tribal, or territorial permit required to\u00a0conduct the activity.<\/p>\n<p>&nbsp;<\/p>\n<p>CITY OF TORRANCE<\/p>\n<p>ARTICLE 13 &#8211; FEEDING OF BIRDS<\/p>\n<p><strong>41.13.1 FEEDING BIRDS PROHIBITED.\u00a0<\/strong>a)\u00a0It is illegal for any person to deposit on or in any public street, public right-of-way, sidewalk, public building, public parking lot, park or any other public property within the city any food or edible thing that can be consumed by birds.<\/p>\n<p>b)\u00a0 \u00a0 It is illegal for any person, while on or in any public street, public right-of-way, sidewalk, public building, public parking lot, park or any other public property within the city, to feed or cause to be fed any bird.<\/p>\n<p>c)\u00a0 \u00a0 Any violation of this section is a misdemeanor, or alternatively, an infraction.<\/p>\n<p>d)\u00a0 \u00a0 This section may be enforced by a city police officer, animal control officer, animal control supervisor, code enforcement officer, or any City employee authorized under Section 11.2.5 of the Torrance Municipal Code.<\/p>\n<p>&nbsp;<\/p>\n<p>WASHINGTON FISH AND WILDLIFE ENFORCEMENT CODE<\/p>\n<p>TITLE 77, CHAPTER\u00a077.15<\/p>\n<p><strong>RCW 77.15.790\u00a0Negligently feeding, attempting to feed, or attracting large wild carnivores to land or a building &#8211; Infraction.<\/strong><\/p>\n<p>(1) A person may not negligently feed or attempt to feed large wild carnivores or negligently\u00a0attract large wild carnivores to land or a building.<\/p>\n<p>(2) If a fish and wildlife officer, ex officio fish and wildlife officer, or animal control authority, as\u00a0defined in RCW\u00a016.30.010, has probable cause to believe that a person is negligently feeding,\u00a0attempting to feed, or attracting large wild carnivores to land or a building by placing or locating\u00a0food, food waste, or other substance in, on, or about any land or building, and the food, food\u00a0waste, or other substance poses a risk to the safety of any person, livestock, or pet because it is\u00a0attracting or could attract large wild carnivores to the land or building, that person commits an\u00a0infraction under chapter\u00a07.84\u00a0RCW.<\/p>\n<p>(3) Subsection (2) of this section does not apply to:&#8230;<\/p>\n<p>&nbsp;<\/p>\n<p>BOROUGH OF BAY HEAD, NEW JERSEY<\/p>\n<p>ARTICLE\u00a0VI:\u00a0FEEDING OF UNCONFINED WILDLIFE<\/p>\n<p><strong>\u00a7 69-44\u00a0Purpose.\u00a0<\/strong>The purpose of this article is to prohibit the feeding of unconfined wildlife in any\u00a0public park or on any other property owned, operated or controlled by the Borough of\u00a0Bay Head, so as to protect public health, safety and welfare, and to prescribe\u00a0penalties for failure to comply.<\/p>\n<p><strong>\u00a7 69-45\u00a0<\/strong><strong>Definitions and word usage.<\/strong>\u00a0For the purpose of this article, the following terms, phrases, words, and their\u00a0derivations shall have the meanings stated herein unless their use in the text of this\u00a0article clearly demonstrates a different meaning. When not inconsistent with the\u00a0context, words used in the present tense include the future, words used in the plural\u00a0number include the singular number, and words used in the singular number include\u00a0the plural number. The word &#8220;shall&#8221; is always mandatory and not merely directory.<\/p>\n<p>FEED<\/p>\n<p>To give, place, expose, deposit, distribute or scatter any edible material with the\u00a0intention of feeding, attracting, or enticing wildlife. Feeding does not include\u00a0baiting in the legal taking of fish and\/or game.<\/p>\n<p>PERSON<\/p>\n<p>Any individual, corporation, company, partnership, firm, association, or political\u00a0subdivision of this state subject to municipal jurisdiction.<\/p>\n<p>WATERFOWL<\/p>\n<p>Any bird that frequents the water, or lives about rivers, lakes, etc., or on or near\u00a0the ocean; an aquatic fowl, including but not limited to ducks, geese, swans,\u00a0heron, and egrets.<\/p>\n<p>WILD ANIMAL and\/or WILDLIFE<\/p>\n<p>All animals that are neither human nor domesticated. Includes any animal which\u00a0is not normally domesticated in this state, including but not limited to bears,\u00a0coyotes, deer, feral cats, foxes, rodents, groundhogs, opossums, raccoons,\u00a0skunks, waterfowl, and the like.<\/p>\n<p><strong>\u00a7 69-46\u00a0Prohibited conduct.\u00a0<\/strong>No person shall feed, in any public park or on any other property owned, operated,\u00a0or controlled by either the Borough of Bay Head or any private owner, any wildlife,\u00a0excluding confined wildlife (for example, wildlife confined in zoos, parks or\u00a0rehabilitation centers, or unconfined wildlife at environmental education centers).<\/p>\n<p>A.\u00a0The feeding of wild animals and\/or wildlife is prohibited.<\/p>\n<p>(1)\u00a0No person shall purposely or knowingly, as said terms are defined in Title\u00a02C of the New Jersey Revised Statutes, feed, bait, or in any manner\u00a0provide access to food to any wild animal or waterfowl in the Borough on\u00a0lands either publicly or privately owned.<\/p>\n<p>(2)\u00a0No person shall purposely or knowingly leave or store any refuse, garbage,\u00a0food product, pet food, forage product or supplement, salt, seed or\u00a0birdseed, fruit, or grain in a manner that would constitute an attractant to\u00a0any wild animal or waterfowl.<\/p>\n<p>(3) No person shall fail to take remedial action to avoid contact or conflict with\u00a0wild animals, which may include the securing or removal of outdoor trash,\u00a0cooking grills, pet food, bird feeders or any other similar food source or\u00a0attractant after being advised by the Borough to undertake such remedial\u00a0action. Further, after an initial contact or conflict with a wild animal, no\u00a0person shall continue to provide, or otherwise fail to secure or remove, any\u00a0likely food sources or attractants, including but not limited to, outdoor trash,\u00a0grills, pet food, or bird feeders.<\/p>\n<p>B.\u00a0The feeding of other songbirds and other backyard birds is permitted. Feeding of\u00a0other songbirds and other backyard birds shall be permitted outdoors at such\u00a0times and in such numbers that:<\/p>\n<p>(1)\u00a0Such feeding does not create an unreasonable disturbance that affects the\u00a0rights of surrounding property owners and renders other persons insecure\u00a0in the use of their property;<\/p>\n<p>(2)\u00a0Such feeding does not create an accumulation of droppings on the property\u00a0and surrounding properties;<\/p>\n<p>(3)\u00a0Such feeding does not become an attractant for rodents or other wild\u00a0animals; and<\/p>\n<p>(4)\u00a0Bird feeders are placed at least five feet above the ground.<\/p>\n<p>C.\u00a0Enforcement. Each property owner shall have the duty to remove any above-named materials or device placed on the owner&#8217;s property in violation of this\u00a0chapter. Failure to remove such materials or device or to make such\u00a0modifications within 24 hours after notice from the Borough shall constitute a\u00a0separate violation of this chapter. Ocean County Health Department Personnel,\u00a0the Zoning Officer, the Animal Control Officer, and all Police Officers of the\u00a0Borough of Bay Head are hereby given full power and authority to enforce this\u00a0chapter. No person shall hinder, molest, or interfere with anyone authorized or\u00a0empowered to perform any duty under this chapter.<\/p>\n<p>D.\u00a0Penalties. Any person violating any provision of this chapter shall be liable to a\u00a0fine not less than $50 nor more than $500 for each offense, together with the\u00a0costs of prosecution. A separate offense shall be deemed committed on each\u00a0day or part of each day during which a violation occurs or continues.<\/p>\n<p><strong>\u00a7 69-47\u00a0Enforcement.<\/strong><\/p>\n<p>A.\u00a0This article shall be enforced by the Police Department, Zoning Officer or Code\u00a0Enforcement Officer of the Borough of Bay Head.<\/p>\n<p>B.\u00a0Any person found to be in violation of this article shall be ordered to cease the\u00a0feeding immediately.<\/p>\n<p><strong>\u00a7 69-48\u00a0Violations and penalties.\u00a0<\/strong>Any person who violates this article or fails to comply with any of its requirements\u00a0shall, upon conviction thereof, be subject to the maximum fines and penalties\u00a0established under N.J.S.A. 40:49-5 and as same may be amended from time to time.\u00a0Each and every day a violation of this article shall exist shall constitute a separate\u00a0violation.<\/p>\n<p>&nbsp;<\/p>\n<p>WILMINGTON, DELAWARE<\/p>\n<p>CHAPTER 3 &#8211; ANIMALS<\/p>\n<p><strong>Sec. 3-17. &#8211; Feeding pigeons, sea gulls, waterfowl and wild animals prohibited.<\/strong><\/p>\n<p>(a)\u00a0It is the intent of this section to protect the health, safety and welfare of the community and its wildlife by\u00a0prohibiting the feeding of pigeons, waterfowl, sea gulls and wild animals in order to prevent public\u00a0nuisances and to protect the species. Feeding pigeons, waterfowl and sea gulls causes a congregation of\u00a0said birds resulting in an accumulation of feces or droppings which in turn increases the potential for\u00a0damage to public property, water quality problems and the spread of disease to residents. Studies have\u00a0shown that feeding waterfowl and gulls may interrupt normal migration patterns, cause nutritional\u00a0problems and\/or promote the spread of bird diseases. Further, the feeding of wild animals is disruptive to\u00a0the natural feeding habits of wildlife, and may result in the concentration of wild animals at artificial\u00a0feeding areas, making them more susceptible to disease transmission. Wild animals can carry many\u00a0diseases and parasites that readily spread to people and pets.<\/p>\n<p>(b)\u00a0For purposes of this section, the following terms shall have the meanings ascribed to them in this\u00a0section, except where the context clearly indicates a different meaning:<\/p>\n<p>Feed\u00a0means to give, place, expose, deposit, scatter or distribute any edible material, including but not\u00a0limited to, grain, seed, greens, bread, fruit, pet food or other miscellaneous food scraps with the intention of\u00a0feeding, attracting or enticing wildlife.<\/p>\n<p>Songbird\u00a0or\u00a0other backyard bird\u00a0includes birds of the suborder oscines or passerine including but not\u00a0limited to larks, jays, cardinals, shrikes, finches, and orioles, characterized by a vocal apparatus highly\u00a0specialized for singing.<\/p>\n<p>Waterfowl\u00a0means any bird that frequents the water, or lives about rivers, lakes, etc. or on or near the sea,\u00a0including but not limited to ducks, geese, swans, herons, and egrets, whether migratory or not.<\/p>\n<p>Wild animal.\u00a0See section 3-1.<\/p>\n<p>(c)\u00a0It shall be unlawful for any person to feed any pigeon, sea gull, waterfowl or wild animal in or on any\u00a0sidewalk, street, highway or park, or upon any other public property, or upon any private property without\u00a0the consent of the owner of such private property.<\/p>\n<p>(d)\u00a0Feeding of songbirds and other backyard birds shall be permitted outdoors on private property at such\u00a0times and in such numbers that:<\/p>\n<p>(1)\u00a0Any apparatus used to feed such birds does not become an attractant for wild animals; and<\/p>\n<p>(2)\u00a0Bird feeders are placed where wildlife other than songbirds would have a difficult time eating from\u00a0them.<\/p>\n<p>(e)\u00a0The provisions of this section are declared to be separate and severable. The invalidity of any clause,\u00a0sentence, paragraph, subdivision, section or portion of this section, or the invalidity of the application\u00a0thereof to any person or circumstances shall not affect the validity of the remainder of this section, or the\u00a0validity of its application to other persons or circumstances.<\/p>\n<p>&nbsp;<\/p>\n<p>NATIONAL DECLARATION: FERAL CATS AS PESTS<\/p>\n<p>Melbourne, Victoria, Australia<\/p>\n<p>16 July 2015<\/p>\n<p>Feral cats are a nationally significant pest that threaten our unique native fauna.
